Terms of Use

These Terms of Use govern your use of Budge, a messaging service operated by For Nothing Ventures LLC ("Budge," "we," "us," or "our"). By using Budge, you agree to these Terms.

What Budge does

Budge helps you follow through on goals and habits you choose. You can use ordinary text messages to create or change goals, reminders, check-ins, and follow-up plans and to report what happened.

Budge is not a general assistant, coach, therapist, medical service, emergency service, or substitute for professional advice. Do not rely on Budge for medical, mental health, legal, financial, safety-critical, or emergency decisions. If you may be in danger or need urgent help, contact the appropriate emergency service or qualified professional.

Eligibility and availability

You must be at least 18 years old and located in the United States to use Budge. You may use Budge only if you can legally agree to these Terms.

Text messages and consent

By enrolling, you ask Budge to send recurring automated text messages to the mobile number you provide. Message frequency varies based on the goals, reminders, and follow-up cadence you choose, plus responses to messages you send. Message and data rates may apply. Consent to receive messages is not a condition of buying anything.

Text STOP to stop messages. Text HELP for help, or email hello@budgeme.com. A stop request takes effect immediately for future automated messages, although the messaging provider may send a final confirmation. You are responsible for keeping your number accurate and for telling us if you no longer control it. Mobile carriers are not responsible for delayed or undelivered messages.

Your instructions and responsibility

You control the goals you create and the instructions you give. Review confirmations and ask Budge to correct anything that is wrong. Automated interpretation can be mistaken, delayed, or incomplete. You remain responsible for your choices, actions, deadlines, and compliance with law.

You may not use Budge to break the law, harm or harass anyone, send spam, impersonate another person, interfere with the service, probe or bypass security controls, introduce malicious code, or use a phone number you do not control. You may not attempt to extract or misuse another person's information.

Your content

You keep ownership of the content you send. You give us a limited license to receive, store, process, reproduce, and transmit that content only as needed to operate, secure, support, and improve Budge and to comply with law. This license ends when the content is deleted, except for temporary backup copies and records we must retain for legal or security reasons.

Do not send information you do not want processed by an automated messaging service. You represent that you have the rights needed to send the content you provide.

Our service and intellectual property

Budge and its software, design, and other service materials belong to us or our licensors. These Terms give you a personal, limited, revocable, non-exclusive, non-transferable right to use the service. They do not transfer ownership of Budge or permit you to copy, sell, reverse engineer, or commercially exploit the service except where applicable law does not allow that restriction.

Changes, suspension, and termination

You may stop using Budge at any time. You may ask us to delete your account and supported data by texting the service or contacting us.

We may change, suspend, or discontinue the service, or restrict access, when reasonably necessary to protect users or the service, comply with law, address abuse, or operate the product. We may update these Terms. If a change materially affects your rights, we will provide reasonable notice before it takes effect when the law requires it. Continued use after the effective date of updated Terms means you accept them.

Disclaimers

Budge is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise uninterrupted delivery, perfect interpretation, successful completion of any goal, or that every reminder will arrive at a particular time. Some jurisdictions do not allow certain disclaimers, so some of these terms may not apply to you.

Limitation of liability

To the fullest extent allowed by law, For Nothing Ventures LLC and its owners, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from Budge or these Terms. Our total liability for all claims relating to the service will not exceed $100. These limits do not apply where the law does not permit them or to liability that cannot legally be limited.

Disputes and applicable law

Before filing a claim, you and Budge agree to try in good faith to resolve it informally by written notice and allow 30 days for a response. These Terms are governed by the law that applies to the dispute, without creating any right or restriction that applicable law does not permit. Any legal proceeding must be brought in a court that has lawful jurisdiction over both the dispute and the parties. Nothing in these Terms prevents either party from seeking relief in small claims court when eligible.

General terms

If part of these Terms is unenforceable, the remaining terms remain in effect. Our failure to enforce a term is not a waiver. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition, financing, reorganization, or sale of the service or its assets. These Terms and the Privacy Policy are the entire agreement about your use of Budge.
